1. Acceptance of Terms
By accessing or using the Fan Vote Online platform at efanvote.com ('the Platform'), you agree to be bound by these Terms of Service ('Terms'). If you do not agree to these Terms, please do not use the Platform. These Terms apply to all visitors, fans, clubs, and any other users of the Platform.
2. Description of Service
Fan Vote Online is a fan engagement platform that enables sports clubs to offer their fans token-gated voting rights on real-time coaching decisions during games. The Platform facilitates Club Token purchases, live voting, and revenue sharing between Fan Vote Online and participating clubs.
3. Eligibility
You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. If you are registering a club, you represent that you have the authority to bind that club to these Terms.
4. User Accounts
When you create an account on the Platform, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately at [email protected] of any unauthorised use of your account. We reserve the right to terminate accounts at our discretion.
5. Club Tokens
Club Tokens are digital utility tokens purchased on the Platform that grant fans voting rights on coaching decisions. Club Tokens have no monetary value outside the Platform and are non-refundable once purchased. Tokens are non-transferable and tied to the fan's account and chosen club. Fan Vote Online reserves the right to modify token pricing and availability at any time.
6. Club Participation
Sports clubs that register on the Platform agree to the applicable revenue sharing arrangement (Self-Managed: 2% royalty on token sales; Fully Managed: 30% revenue share). Clubs are responsible for ensuring their participation complies with any applicable sporting body regulations. Fan Vote Online reserves the right to suspend or remove any club from the Platform.
7. Acceptable Use
You agree not to use the Platform for any unlawful purpose, to manipulate or interfere with voting outcomes, to impersonate any person or entity, to attempt to gain unauthorised access to any part of the Platform, or to engage in any conduct that could damage, disable, or impair the Platform. Violation of these rules may result in immediate account termination.
8. Intellectual Property
All content, features, and functionality of the Platform — including but not limited to the platform architecture, voting methodology, software, text, graphics, and logos — are the exclusive property of Fan Vote Online and are protected under applicable intellectual property law. International IP protection has been filed via WIPO. Unauthorised reproduction or commercial use is strictly prohibited.
9. Disclaimer of Warranties
The Platform is provided on an 'as is' and 'as available' basis without warranties of any kind, either express or implied. Fan Vote Online does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Platform is at your sole risk.
10. Limitation of Liability
To the fullest extent permitted by law, Fan Vote Online shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, including loss of data, revenue, or profits. Our total liability to you for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Australia. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a revised date. Your continued use of the Platform after changes are posted constitutes your acceptance of the new Terms.
